QH Clothing | Beauty - Vacancy Program Terms and Conditions

Welcome to the QH Clothing | Beauty Vacancy program! By participating, you agree to these Terms and Conditions ("Terms"). It is essential that you read these terms thoroughly to ensure a clear understanding of your rights and responsibilities as a participant in our beauty vacancy program.

1. Eligibility:

  • Age and Residency: To be eligible for participation in the program, you must be at least 18 years old or the legal age of majority in your jurisdiction, and you must reside in a country where the Program is offered.
  • Platform Requirements: Your social media presence is important; therefore, you must have a combined minimum of 1,000 followers across your chosen platforms, which may include Instagram, YouTube, TikTok, among others. Be aware that individual platforms might impose additional minimum follower requirements, so kindly verify these details prior to applying.
  • Agreement and Qualifications: Participation requires your agreement to all Terms, along with possessing relevant skills and experience for the selected program, such as photography or writing expertise, which enhance the quality of contributions made to our program.
  • 2. Ownership and Confidentiality:

    • Content Ownership:
    • Non-Pay per UGC: In instances of non-Pay per User-Generated Content (UGC), QH Clothing | Beauty ("Company") retains the right to utilize, alter, publish, translate, distribute, and exploit any submitted materials—including videos, software, written content, etc. ("Content")—excluding Personal Information, across various media and channels for both commercial and non-commercial activities, without any further compensation. You grant the Company a perpetual, irrevocable, non-exclusive, royalty-free license to employ your Content in such a manner.
    • Pay per UGC: Ownership rights of Pay per UGC content will transition to the Company, encompassing all copyright, publicity, and trademark rights. Consequently, you assign ownership rights to the Company for its utilization as deemed appropriate.
      • Freelance Work: All work produced for the Company, covering freelance tasks such as virtual assistance, editing, SEO, blogging, live selling, application design, and AI programming, will solely belong to the Company and is considered confidential proprietary information. This includes creative assets, marketing materials, customer data, technical specifications, and internal systems. Any disclosure of such confidential information to third parties without prior written consent from the Company is prohibited.
      • 3. Content Guidelines:

        • Originality and Authorship: All content submitted must be original and created uniquely by you.
        • Third-Party Rights: It is critical that submitted content does not violate any third-party intellectual property rights, including copyrights, trademarks, privacy, or publicity laws.
        • Offensive Content: Content must not contain any offensive, defamatory, discriminatory, harmful, or illegal material.
        • Relevance: Contents must align with the interests and themes of QH Clothing | Beauty and its diverse product offerings.
        • Quality Standards: All submissions must adhere to the Company's established quality standards concerning technical specifications, visual attractiveness, messaging clarity, and compliance with brand guidelines.
        • 4. Compensation:

          • Affiliate Program: Specific commission rates and payment terms will be communicated separately to you upon enrollment.
          • Referral Program: Details regarding rewards for referrals will also be provided separately.
          • Pay per UGC: Compensation will range from £20 to £150 per piece of content based on factors such as total follower count, audience engagement metrics, content quality, and agreements established with each creator.
          • 5. Performance and Termination:

            • Review and Feedback: The Company reserves the authority to review all submitted content, provide constructive feedback, or necessitate revisions to uphold quality standards.
            • Probationary Period: Participants new to the program will undergo a probationary period lasting three months to evaluate their skillset, work ethic, and compatibility with the program’s overall expectations. If the required standards are not met during this phase, termination may occur without compensation.
            • Right to Cancel: The Company maintains the right to terminate a participant's eligibility for reasons related to poor-quality output, continued guideline breaches, inactivity, confidentiality violations, or infringement of intellectual property rights. In cases where termination is deemed necessary, no compensation will be provided. Participants are liable for any legal costs incurred due to infringement issues.
            • Termination Notice: Participants may have their involvement terminated with a 30-day written notice via email for any reason. Conversely, participants retain the right to withdraw from the program at any time.
            • Termination for Inactivity: Accounts will be classified as inactive, potentially leading to termination, after a year of non-participation in content creation or program engagement.
            • 6. Delivery and Submission:

              • Deadline: From the date of your agreement, you must deliver the completed video within a period of 14 days.
